By accessing or using Ponder ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
Description of Service
Ponder is a Chrome extension that provides real-time prompt grading and AI-powered improvements for ChatGPT users. The Service includes:
- Real-time prompt scoring (0-100 scale)
- Detailed breakdown across 5 categories
- AI-powered prompt suggestions
- One-click prompt improvements
Account Registration
To use the Service, you must:
- Provide a valid email address
- Be at least 13 years old
- Create only one account per person
- Keep your account credentials secure
- Not share your account with others
You are responsible for all activity that occurs under your account.
Subscription Plans
Free Tier
- 10 prompt gradings per day
- Resets daily at midnight Melbourne time (UTC+11)
- Access to all core features
- No credit card required
Pro Plan ($29/month)
- Unlimited prompt gradings
- Access to all features
- Priority support
- Cancel anytime
Payment and Billing
For Pro subscriptions:
- Subscriptions are billed monthly at $29/month
- Payment is processed securely through Paddle
- You will be charged on the same day each month
- Prices may change with 30 days notice
- All payments are non-refundable except as required by law
Cancellation and Refunds
Cancellation
You may cancel your Pro subscription at any time:
- Cancellation takes effect at the end of your current billing period
- You will retain Pro access until your subscription expires
- You will not be charged for subsequent billing periods
- You will automatically revert to the Free tier
Refund Policy
We offer a 30-day money-back guarantee:
- Request a refund within 30 days of your initial purchase
- Contact ponder@rjbernaldo.com with your request
- Refunds are processed within 5-10 business days
- This guarantee applies to first-time purchases only
Acceptable Use Policy
You agree NOT to:
- Use the Service for any illegal purpose
- Attempt to circumvent usage limits or payment requirements
- Reverse engineer, decompile, or disassemble the Service
- Use automated systems to access the Service (bots, scrapers, etc.)
- Resell, redistribute, or sublicense the Service
- Violate the intellectual property rights of Ponder or third parties
- Transmit viruses, malware, or harmful code
- Interfere with or disrupt the Service or servers
Chrome Extension Terms
By installing our Chrome extension:
- You grant us permission to inject our interface into ChatGPT
- You acknowledge that we only analyze prompts you explicitly choose to grade
- You understand that the extension requires certain permissions (storage, host access)
- You agree to keep the extension updated to the latest version
- You can uninstall the extension at any time
Privacy and Data
Our commitment to your privacy:
- We do NOT store your prompts - All prompts are analyzed in real-time and immediately discarded
- We only store your email, account tier, and daily usage count

Intellectual Property
The Service and its original content, features, and functionality are owned by Ponder and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy, reliability, or completeness of AI suggestions
We do not guarantee that:
- The Service will be uninterrupted, secure, or error-free
- AI-generated suggestions will be accurate or effective
- Any defects will be corrected
- The Service will meet your specific requirements
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PONDER SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or use
- Damages resulting from use or inability to use the Service
- Quality or accuracy of AI suggestions
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim (maximum $348 for annual Pro users).
Service Availability
We strive to maintain high availability but:
- We do not guarantee 100% uptime
- Scheduled maintenance may cause temporary disruptions
- We reserve the right to modify or discontinue the Service
- We may suspend accounts for Terms violations
Account Termination
We may terminate or suspend your account immediately if:
- You violate these Terms
- You engage in fraudulent activity
- Your account is inactive for 12+ months
- Required by law
Upon termination:
- Your right to use the Service will immediately cease
- We may delete your account data
- No refunds will be provided except as required by law
Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective:
- Immediately upon posting for non-material changes
- 30 days after notice for material changes
Continued use of the Service after changes constitutes acceptance of the new Terms.
Changes to Service or Pricing
- We may modify features, limits, or pricing with 30 days notice
- Existing subscribers maintain their current price for their subscription period
- New prices apply upon renewal
Third-Party Services
Our Service integrates with:
- ChatGPT/OpenAI: Subject to OpenAI's terms of service
- Chrome Web Store: Subject to Google's terms
- Paddle: Payment processing governed by Paddle's terms
We are not responsible for third-party services or their changes.
Governing Law
These Terms shall be governed by the laws of Australia, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Melbourne, Australia.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ponder regarding the Service.
